Smoking laws

does anyone know with the smoking laws, if smoking is permitted on balconies?

I am not sure how current this list is. You best bet is to call or email the property directly and re verify they allow smoking.

Smoking is NOT permitted on balconies, according to Hawaiian law. If you are a smoker, be aware that smoke easily permeates to other units. Nothing more nasty than having a nice breakfast on the lanai, with smoke pouring in from the unit above or alongside. I have complained to hotel security multiple times about smokers on the balconies.




Actually PareoB smoking is allowed on the lanai IF the hotel says it is ok. Very few do allow it (for the reason you stated) but unless they have changed the law since 2006 when it was enacted it is not against the law per se to smoke on a lanai (balcony).





The list I provided is a bit old however if smoking bothers you (and it bothers us) don%26#39;t stay somewhere that it is permitted. If you know it is permitted then you have no room to complain, if it is not and someone is smoking then you have every right to complain.

When we went back to Kauai Marriott last year, I was no longer allowed to smoke out on the balcony (this was always permitted in the past even if the room was non-smoking). Had to go to designated smoking areas. The front desk explained the law forbade smoking within I think something like 25 feet of any inhabited dwelling.





Friend of ours who seldom smokes, was really annoyed when he was no longer able to have a nice cigar with his cognac at Stevenson Library on their balcony at the Grand Hyatt.




In Hawaii, as in California there is almost no place you can smoke any more other than your own home and CA is trying to do away with that.





No beaches, no parks, no place indoors including bars and clubs (there ought to be a law REQUIRING somking in clubs %26amp; bars), restaurants, offices, lobbies, etc.




I am glad to hear the cigar smoker wasn%26#39;t allowed to smoke in the Stevenson Library. That would really stink up the place, and it is certainly a bar, not a cigar lounge.




I wish we could kill once and for all the most common ';urban myth'; rearing its head on this forum....





At present, it is LEGAL to smoke tobacco in the parks, on the beaches, and sidewalks of Honolulu/Oahu, Maui and Kauai Counties. Only the Big Island has passed a county ordinance prohibiting the practive on County owned/adminstered park lands, public facilities and parking lots.





Some hotels, such as the Hyatt Regency Waikiki allow it ONLY while on the lanais (on designated floors).

Once again Amberloo thanks for setting the record straight. Should also mention that there are ';smoke spots'; located all along Waikiki, all located 25%26#39; from the nearest ';door or window';...we deal with the same laws in Seattle...not a problem.




We stayed there Dec 9-12 and they had no problems with us smoking on the balcony. There is even a sign in the room requesting you not toss butts of the balcony.




I was soo exciting thinking it was illegal for people to smoke on their lanais. I paid a lot of money for my ocean view balcony and to have it ruined by a smoker is horrible.





But sadly it looks like to many places allow smokers to ruin non smoker, vacation, lanais and views. I hope more hotels follow suit to not allow smoking on their balcony. I had a huge smoker above my apt and I never got to use the balcony at all, so this is probably why I feel so strongly about this.. I hate how inconsiderate some smokers are.
