Ok we will be staying at the Hyatt on kauai and I am just wondering if I can sunbathe topless there discreetly? Anyone know?

Topless at the Hyatt will probably land you in the local bastille. Nude sunbathing is against the law in the STATE of Hawaii.
Now, I have heard of nude beaches further north, but if the code is enforced that might put the binders on a very special vacation.
You might ask around where you can go topless, without a hassel. Secret beach was one place that used to be popular for that.
Hope that is not a primary consideration since there are plenty of things to experience and see on the Garden Island.

You can probably manage it if you have lots of self confidence, because you%26#39;ll draw a lot of looks. Might want to consider an out of the way beach rather than a resort beach.

Being topless is not considered the same as being nude in Hawaii. There have been several court cases regarding breast feeding in public and equal protection for women which set precedents permitting the activity.
The statutes against nudity refer to ones, ahem, ';privates';, not breasts.
However, while it is virtually unthinkable you would be arrested for being topless, and impossible to be convicted, you may get hassled by police to put your top back on...but even that happening is not very likely, and I haven%26#39;t heard of someone being confronted over mere topless-ness in many years.
There are some who passionately contend, as supported by a variety of parsed judicial decisions and findings, that fully nude sunbathing is also legal as long as there is no sexual intent. Some decisions use the term ';intentionally affront';.

But, you would definitely be taking some level of risk to try it on virtually any beach.
Hopefully if you attempt this at the Hyatt, you will do so at the adults-only pool. :)

Actually, I think rockytop has it right, if you don%26#39;t mind offending the less liberal types, you%26#39;ll be fine and I%26#39;m sure you won%26#39;t get in trouble. It%26#39;s not a beach easy to be discreet on.

I have seen topless and nude sunbathing at the Mahaulepu beaches, down the long dirt road past the Hyatt, back when there were less people in general visiting Kauai. But with more and more people visiting those beaches, discretion is certainly warranted there.
As mentioned above, there are beaches on Kauai that it is quite common to go topless and/or nude but I%26#39;m not going to blast those locations on the web right here.
As far as sunbathing discreetly, as long as nobody is around, then you can probably use your judgement, and then just cover up when someone comes. There are plenty of uncrowded beaches on Kauai. I just know that crowded beaches frequented by families is not the best time to get that all over tan. ;-)
Modesty has become much more prevalent on Kauai than say in the seventies, when I remember getting a shocking eyefull on several occasions as a teenager!
You can always ask someone at the Hotel if it would be ok. If not, ask them if there is a place where it would be ok, say in a more secluded area of the hotel or on their beach??
They may have a spot reserved for topless sunbathers or a place they prefer, because, it isn%26#39;t illegal so they may have set up an area in the hotel for it. They just might not advertise that they have it.
I realize your post is a few years old, how did it go, were you able to find a spot to sunbath topless there?
